Terms & Conditions

1. The Contract between you (the customer) and us (AllyM)
Please note that we must receive payment in full for the goods that you ordered before your order can be accepted. Once full payment has been received by us we will send you an acknowledgement email to the email address you provided us with on you the order form. Please note that this email is not an order acceptance confirmation from AllyM. Our acceptance of your order takes place on the dispatch of the products you have ordered, unless we notify you otherwise. Please note that we reserve a right not to accept your order. Our acceptance of your order brings into existence a legally binding contract between you (the customer and us AllyM). Please do not use this site if you do not meet the requirements to execute a legally binding contract.
 
2. Return and exchange 
2.1 Fully priced goods.
If you are not satisfied with your purchase within 7 days of receipt, AllyM will provide a full refund or exchange of the item. Please keep in mind that due to their organic nature, pearls are not uniform in appearance or colour. Please note that the item you return must be in new, unused, and unworn condition with all the original packaging. AllyM will not accept any item with any indication that it was used. In such cases, the item will be returned to the purchaser.
 
Before your return you must notify us within 48 hours of receiving an item by emailing us at orders@AllyM-Pearls.co.uk quoting your order number. We will then provide you with your Return Reference (RR) number and the delivery address, which you will need for your refund and exchange.
Please also include the original receipt in the returned parcel and state your Return Reference (RR) number on the receipt. Please note that any returned items that are not accompanied by an official Return Reference number will not be accepted.
You must return the goods by Recorded/Signed for Service only.  Please note that all postal or courier costs for returned goods are the customer's responsibility and will be reimbursed by us only in the case of incorrectly supplied goods. Please keep your proof of postage certificate, as AllyM will not be responsible for any goods lost or damaged in transit. Please note that AllyM do not accept liability for returned goods if you do not return them to us via Royal Mail Special Delivery, Tracked and Signed for postal service, DHL or FedEx.
In the event of an exchange please be aware that you will be required to pay any difference in cost and any additional carriage, shipping. Any unused credit will remain on your account until your next purchase. Please note that exchanged items can only be dispatched after the returned goods have been received and passed a satisfactory quality control check.
 
2.2 Sale Items
If you are not satisfied with your purchase we request that all sale items are returned within 3 working days of the date you received your Return Reference (RR) number. Please keep in mind that due to their organic nature, pearls are not uniform in appearance or colour.
Any items returned outside the above mentioned time frame are accepted at the discretion of AllyM and can only be refunded as an AllyM store credit or an exchange for different item.
Please note that the item you return must be in new, unused, and unworn condition with all the original packaging. AllyM will not accept any item with any indication that it was used. In such cases, the item will be returned to the purchaser.

2.3 Earrings and bespoke or specially commissioned items
Please note that we are unable to accept returns or exchanges on pierced earrings, bespoke or specially commissioned items. Bespoke and commissioned items cannot be refunded as consultation throughout the design process would have taken place. For hygiene reasons AllyM cannot exchange or refund earrings unless they are faulty.
 
3. Cancellation of order by AllyM
3.1 As AllyM designs are handmade, we reserve the right to cancel your order in an unlikely event of 
3.1.1 having an insufficient stock to deliver the goods you have ordered, 
3.1.2 the ordered item is no longer available, 
3.1.3 we do not deliver to your area,
3.1.4 one or more of the items you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information,
 
3.2 If we do cancel your order we will contact you by email or by telephone and we will re-credit the amount to your credit card within 30 working days of your order. Please note that AllyM is not obligated to offer any compensation for your disappointment suffered.
 
4. Delivery
4.1 We will deliver the goods ordered by you to the address you give us for delivery at the time you make your order. It is solely your responsibility to ensure that the delivery address you provided us with while making a transaction is correct.  
 
4.2 UK Delivery
Delivery to addresses within the UK will be dispatched within service within 7 days. 
Please note that parcels will need to be signed for in person. Please make sure the delivery address is accurate when ordering from AllyM-Pearls.co.uk and that there will be someone to sign and take delivery for the goods when they arrive. If you miss the delivery, Royal Mail will leave information note and you will be able to collect your parcel from the post office.
Price breakdown below: 
Orders under £50.00 are sent via Royal Mail Special Delivery service and charged at £5.00 per order.
Orders over £50.00 will be sent via Royal Mail Special Delivery service and charged at £9.50 per order. 
Orders over £150.00 will be sent via Royal Mail Special Delivery service and are free of charge.
Please note that AllyM-pearls.co.uk cannot be held responsible for any postal delays once the goods have left our premises. 
 
4.3 Orders outside the UK (Europe only)
Delivery to addresses outside the UK (Europe only) will be dispatched within service within 7 days. 
Please note that parcels will need to be signed for in person. Please make sure the delivery address is accurate when ordering from AllyM-Pearls.co.uk and that there will be someone to sign and take delivery for the goods when they arrive. If you miss the delivery, Postal Service will leave information note and you will be able to collect your parcel from the post office.

5. Our liability
5.1 AllyM shall not be liable to you unless you notify us by email within 7 working days if the delivery of the products ordered were either damaged, or sent incorrectly. Please keep in mind that due to their organic nature, pearls are not uniform in appearance or colour. Upon  your request our only obligation to you will be to:
5.1.1 to replace damaged product/s 
5.1.2 to make good any shortage or non-delivery; or
5.1.3 to replace any goods that are damaged or defective (once the items have been returned and inspected by us. Please note AllyM will not accept any item with any indication that it was used. In such cases, the item will be returned to the purchaser); or
5.1.4 to refund to you the amount paid by you for the goods in question in whatever way we choose.
 
5.2 If you do not receive goods ordered by you within 14 working days of the date on which you ordered them, we shall have no liability to you unless you notify us by email of the problem within 14 days of the confirmed dispatch date. If you notify us of a problem under this condition, our only obligation will be, at your option either:
5.2.1 to make good any shortage or non-delivery; or
5.2.2 to refund to you the amount paid by you for the goods in question in whatever way we choose
 
5.3 AllyM shall not be liable in any way for any death or personal injury resulting from your negligence and / or due to inappropriate use of the products.
 
5.4 Please note that our terms and conditions are not intended to limit consumer rights nor statutory rights.  
 
5.5 You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.
 
5.6 We shall not be held responsible for any delays once the goods have left us and are in possession of the courier or Royal Mail
 
6. Pricing, Delivery, Discount Codes and Gift Voucher / e-voucher Redemption 
6.1 The prices payable for goods that you order are as set out in our website. 
6.1.1 All of our prices are in UK and you will be billed in UK Pounds. If you purchase from outside the UK, currency fluctuations and credit card charges may make a difference to the amount billed on your credit card. 
 
6.2 Please note you may be required to pay extra for delivery and it might not be possible for us to deliver to some locations. Our delivery charges are set out in our website. 
 
6.3 Promotional discount codes: We may offer promotional discount codes (either directly or via third parties) which may apply in respect of any, or certain specified, purchases made though this Website. Such codes may only be applied to purchases of full-price items and cannot be used in conjunction with any other offer or discounts.
 
6.4 Gift Voucher / e-voucher redemption 
6.4.1 AllyM gift vouchers and e-vouchers can be only redeemed online at AllyM-Pearls.co.uk website and the recipient must register for their AllyM account. 
6.4.2 When redeeming gift voucher or e-vouchers online you will be required to enter the gift voucher or e-voucher ID during checkout as given in the recipient email.
6.4.3 The total value of an online order must come to the same or greater value than that of the voucher or e-voucher, otherwise the system will be unable to process the payment.
6.4.4 If you have to return goods you have purchased online using gift voucher or an e-voucher, we will provide the refund in the form of an e-voucher or Gift voucher/s or account credit
6.4.5 Gift vouchers and e-vouchers may not be exchanged for cash and are not refundable

We reserve a right to make changes to the material on this website, or to the services and prices described on the website, at any time and without any notice. The material on this website may be out of date, and we make no commitment to update such material. 10. Events out of our Control
AllyM will not be in breach of this Agreement or otherwise liable for any delay in performance if to the extent that any delay or failure is due to circumstances beyond its reasonable control (including, without limitation, strikes, lockouts and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident).
 
11. AllyM designs
All of our designs are handmade by AllyM and may feature pre-made components such as chains, charms or clasps.  Please note that silver may change the colour and darken. It is advisable for the silver components to be cleaned and polished by hand
AllyM designs also consist of semi-precious stones, freshwater pearl, CRYSTALLIZED™- Swarovski Elements and other types of beads. 
 
12. Colour Reproduction
We assure you that every effort has been made to reproduce colours on the site as accurately as possible.  Please note that some computers reproduce colours in slightly different ways, therefore exact matches may not be possible over the Internet.  Please note that while ordering the product, colours may slightly differ from what you can see on your screen.  Please also note that, due to their organic nature, freshwater pearls do vary in sizes, shapes and colour therefore may not be perfect.
